@bradstevens This is the wrong thread, but there has long been a fundamental disconnect between what atheism is and what Christians imagine atheism must mean. That's where the nihilism slur comes from. We could probably throw down a fifty-page thread about it, but fundamentally it comes down to a difference in understanding the nature of reality so complete that one side honestly can't comprehend the other.
Most atheists behave like there is a God. And you don't need to be a Christian or religious to make that observation. So, I fully comprehend your understanding. I just put little stock in people's words and place most of it in their actions.

Intent is part of their mental state, is it not? How can you determine a bad intent (rape) when they're shit faced, any more than you can determine consent on the shit faced girl's part?
It's a complicated question. What you are saying makes sense, but I'd prefer "intoxication is no substitute for poor decisions". That's where I always fall on mental health issues (e.g., insanity defense).
The legal arguments are one thing and I pride myself on not being a lawyer, but from a logical perspective, I cannot absolve the boys of blame, even though I am well aware (from what I can remember) of the impact alcohol has on one's judgment (@larsiu I may or may not have drunkenly had relations with a rather large lady behind some bushes at the Villas). I made a poor choice and have to face that shame for the rest of my life.
