They do not say that being intoxicated makes consent impossible. They simply state that if you become so intoxicated that you lose the capacity to consent, then the court either should or should not (depending on the state) care whether or not you reached that level of intoxication of your own volition.

 

I know one of the men claimed he was to incapacitated to give consent and the Jane Doe performed oral sex on him anyway.

 

Maybe you should look into the case before you pretend like you have the first fucking clue.

@bar-down I'm sure. According to the article, that's how it happened in Minnesota - a high profile conviction was overturned by the courts, and the law was changed.

If you think about it, it makes sense. If someone is genuinely so intoxicated that they are no longer capable of meaningful consent, then it really doesn't matter how they got to that state. I mean, we don't draw that distinction with other mental states. You rape an unconscious girl, no one asks if you knocked her out, or if she voluntarily went to sleep on her own. It's still rape, either way. You don't get to say, "Well, she was talking in her sleep, and she said yes." We draw a bright line - if you're unconscious, you can't consent, no matter how you got that way.

Was she unconscious?

She was taken advantage of by terrible, despicable people who deserve some punishment. But is it rape? Maybe? 

I know I wouldn't put myself in that situation b/c i'm 51 and was never in that situation. Which is actually not true. I left and locked the door on my way out a couple times.

@larsiu @goat  not reading the 110 page complaint but a two second review shows she was drinking all over. She also brought a dram shop action against a bar.  So the boys clearly weren’t the only ones feeding her booze or able to know how much she had co aimed etc.  

goat on those alcohol laws they’re funny. She wouldn’t be allowed to bring that action in many states. Only an innocent third party can sue the bar for injuries for overserving someone else ie not the plaintiff

How common is it for a state AG with a clear political agenda to assume the role of lead special investigator after the DA determined there wasn't enough evidence to prosecute?

I don't know much about the specifics of the case...

I don't know much about the specifics of the case either, but as to the first point, my admittedly limited understanding is that the Cornell campus police didn't fully turn over alleged victim and witness interview tapes and transcripts to prosecutors, so the DA lacked grounds to move forward all because of the shoddy police work.

@socks-shorts-1-2-3-swish I’ve done a few civil suits against universities.  The U cops are usually commissioned by county pds and certified by state standards blah blah. In my experience generalizing they’ve been totally worthless. Way worse than regular cops

It’s silly right? But under the laws Goat advocates for, that guy was raped, assuming he’s telling the truth.

 

What’s funny is leftists like yourself can recognize the manifest gender differences as it relates to sex, that’s what prompted your “lmao”.

 

However, this girl was likely fed so much feminist horseshit about how the only thing that should govern sexual behavior is consent. She thought there was nothing inherently wrong with her actions. 

That is until word got out about what she did, and the understandable shame attendant with her actions hit her like a ton of bricks, those gender differences made themselves real manifest.

She was apparently good with snorting K off d*cks. As Goat said, I too have led a sheltered life. 

What a completely awful situation. And of course, if she were my daughter I'd have already bought an arsenal of weaponry but that doesn't mean this qualifies as rape under the law. Not beyond a reasonable doubt.

@larsiu My understanding is that she was not unconscious. I only used that to highlight that if someone is in a mental state that makes consent impossible, we don't normally care how they got into that state. So the fact that 19 states make an exception for voluntary intoxication is a bit of an anomaly. My guess is we'll see that number gradually dwindle down to close to zero over the next few years.

Campus cops seem to spend 100x more time on writing parking tickets than on wild (often Greek) parties, drugs, and drunken behavior

I’m not sure how you got “hating women” out of anything I’ve said in this thread. It’s another one of your moronic non-sequiturs. 

I don’t take the Jane Doe’s words at face value, especially considering the 180 her texts reveal on the supposed criminality of the nights events once she became a social pariah. For that matter I don’t see any reason to believe the men unquestioningly either. 

I don’t think Tish James will pursue rape charges against the Jane Doe. As you pointed out, she’s a political hack.
