You should be able to sue, or you should be able to get a recovery? Because you can do the second and now have a better chance of recovery than you would in a typical lawsuit.If the vax harms me I should be able to sue.

That’s the point. We are not pulling any vaccine. That said, I think a case can be made for requiring polio vaccinations for school because of long term consequences. I also think we should be asking hard questions about the general idea of mandates.
In thinking about this issue this morning, what would you think of subjecting every black HS student in , say, Chicago, St,L. Baltimore to a GSR screening every Monday and those who test positive get a home visit. That would be more beneficial than some vaccine mandates. But we would never do that.

The Colorado supremes held that the 4th won’t apply if the search is pursuant to an adopted “safety plan” . Technology might trump this issue anyway. I don’t think it will be long before a scanner could identify GSR without a swab.
As for the 14th, many claim that juvenile gun crime is a public health issue. If the remedial measures is tied to lowering youth gunfire, I think it could pass muster.

A safety plan refers to plans that prevent future crimes, not detecting/punishing a past one. SCOTUS has ruled on this. What you are talking about is to detect past crimes. If you wanted to do a screening for explosives, like they do with TSA, you could probably do that.4th and 14th Amendments.

No way in a million years a public health issue warrants targeting only black youth. That's as clean a violation of equal protection as there is. Nor is doing a GSR screening a "remedial" measure.
We are burying more and more black kids from gunfire. The problem in big cities is overwhelmingly a black problem. If any other disease or condition produced as much death and mayhem among black youth as gunfire, we’d be all over it. We can’t deal with this by pretending it’s a problem equally distributed between black and whites. We’ve gotta stop being cowards when it comes to race. I think good arguments can be advanced to establish a non-discriminatory purpose in focusing remedial measures in the black neighborhoods, schools, and students.
As far as GSR testing is concerned, I don’t agree it’s about law enforcement instead of crime prevention. If a kid has a positive GSR test, that very likely means he has illegal access to a gun which should alert authorities.
