IIRC, the GOP laws included elements of interstate commerce.  Your proposal looks like a straight creation of a new crime without including typical federal hooks like funding or interstate commerce.

It’s a mystery.  The only explanation I can come up with is a severe TDS infection.  There are many Democrats (Az Sen. Kelly is one) who have the chops to stand up to this bullshit, but they don’t.  Fetterman can use some company.  Colorado gov. Polis has weighed in on the side of political sanity, but he gets no traction.

@co-hoosier unreal. The law prior was fine.  But of course it’s a goofy lesbian gov.  Freak show. Zero common sense.  Why on earth would you remove the guidelines and standards post 24 weeks.  Hell it protects drs.  No criteria is absolutely inane.  

Democrats.  Just the absolute Fing worst.

@bar-down This isn't about virtue signaling. This all started because a woman in her 33rd week was told her baby had suffered a massive prenatal stroke and would be born a vegetable. Because the baby was technically still viable, the Massachusetts hospital refused to provide an abortion, and she had to go out of state. They passed a law in 2022 to address this specific instance. Apparently the new law this year was intended to simply remove the necessity of predicting all possible future cases and leave it up to doctors. 

This law does not provide for abortion on demand up until birth. It requires doctors follow standards of care. Professional ethics. Was the law necessary? Was the 2022 update not good enough? I don't know. But this law is most certainly not what you guys seem to think it is.

@goat I know exactly what the law is.  It gives complete discretion to the mother and dr up to birth.  The prior gave four specific circumstances 1) preserve life of gestating person 2) preserve gestating persons physical or mental health 3) defect or diagnosis that would result in death of fetus 4) grave fetal diagnosis incompatible with sustained life outside of the uterus without extraordinary medical interventions.”

now those standards are stripped. It’s whatever a dr wants to do.  It absolutely provides for abortion to birth.  The scenario you set forth would have been covered by the old law.  Ethics?  Standard of care?   The above is the standard of care. Now the standard of care is simply the procedure used to abort.  Was it performed safely?  What else could it be?  All abortion is death.  Now it’s allowed to birth with no specific cases.  It’s a virtue signal from a lesbo governor.

Before advocating for federal law, we must first consider whether there is federal authority for such a law.  That’s neither liberal or conservative, it’s about the fuckin organic law.

The law allows a doctor to say “the gestating person was at 38 weeks and terribly frightened of giving birth, in my professional opinion, the gestating person would have suffered post partum depression so we killed the kid to treat the depression.” There is so much wrong here I don’t know where to begin.

Incorrect. For a doctor to do such a thing would be a grave violation of medical rules and they would be stripped of their ability to practice.

@bar-down The law requires doctors to follow medically recognized standards of care. This does not mean they can just recommend an abortion for whatever reason they want. They still have to follow what the licensing board expects them to follow. 

Again I don't know if this law was a good idea. But you guys are absolutely swallowing fear mongering about it. Doctors are not suddenly free to provide late term abortions on a whim.

you’re wrong. The limitations were removed. The standard is whatever is generally done. In person counseling. No D&x or whatever.  Then the actual procedure of killing the baby. And probably some follow up.  But the decision is the drs without linitation.   If you sued and found others that agree with the drs decision which you always can that’s it. No case.  The barriers were removed

Agree.  I don’t think there is any scenario where killing  a healthy full term kid in the womb is an appropriate standard of care.  That’s why I said there is so much wrong.  The Dr would obviously defend with the professional judgment rule and that might be enough.
