If they have lived together for two weeks and this is happening, it’s probably best that they part ways.
- @kkott My dad gave me and my roommate pepper spray before my freshman year at IU! I think I carried it when I walked at night for about a week. Lol
@zeke4ahs Thought I'd said this in a post, but maybe deleted it. But, I keep pepper spray in my car and desk at work where I'm often the only one in the office, and bought it for all the important women in my life a few years ago. Ironically I'd guess I'm the only one that knows where theirs is at this point.
If I go to a pool party, come home and get sprayed, you better believe I'm going to defend myself.
I don't condone violence, but there comes a time where one has to defend themselves. This would fall into one of those times.
If that's what happened.
If so, then the girlfriend should still be under charges of assault, right?
,
Hope the young man has a mom or dad, aunt or uncle, to give some life advice regarding his current situation and his future.

I know that.If that's what happened.

Both were arrested.
Both were released without charges.
If the girl pepper sprayed without cause, i.e. fear, she shouldn't be off the hook. If she did have fear, well then.
So I said 'if that's what happened" to the defending himself position.
@openwheel I'm not in LE, but I'd imagine they're dropping a case like this if both parties agree to that and aren't going to testify, and probably what happened. I'd guess there are 2 different stories about what led up to the pepper spray and both are probably just wanting to drop it at this point. Fine with whatever the staff does here.
@kkott I've handled a lot of cases like this. When the police choose to arrest both sides, and there's no other evidence but those two parties, the cases tend to fall apart because both assert the right to remain silent, and then neither can be called.
Now, if there's a video, and a witness to lay the foundation for the admission of the video into evidence, that's different, and the State can charge both and move forward.
But also, the Monroe County Prosecutor's Office might have just decided they didn't want to bother with it. They approach the system a bit differently than the smaller "tough guy" counties.
What I read was there is video and witnesses. Still probably a couple youths that got out of control a bit and they decided to drop it.@kkott I've handled a lot of cases like this. @walt542 That's one possibility. It's also possible that the police are still investigating, and the prosecutor is waiting for those results.
Also, my experience with the media reporting on my cases is that the reporting often has errors. As do police reports. So, if you're basing your opinion on media reports gleaned from police reports, I'd hesitate.
