As @unclemark is so fond of saying, “this is different”. I’m well aware of the federalism issues in election law, and I was highly critical of the Biden Administration sticking its nose into Georgia affairs and causing removal of the All Star game.
But having dealt with HAVA for a few cycles, I know there is also a federal role. The administration tried to thread the needle in the EO you cited. Maybe it stretches things a little, but not in a blatently improper fashion. As I mentioned, I won’t take the time to review the details and look at the U.S.C. and applicable cases to give a more definitive opinion that I would have charged thousands for back in the day😊

im having trouble following you. Are you saying the federal government doesn’t have the authority, or are you saying the federal government has the authority, but that authority is not with the executive? The EO cites a number of sections of the U.S. Code that it believes has delegated authority to the executive, have you reviewed those?
In any event, the section about post Election Day counting will be moot, SCOTUS, has accepted certain on that issue.
