IIUC, he wasn't a target until he became tangentially included in some other undisclosed investigation. It was only after he was brought to their attention that the FBI started looking his way.

Who knows.. could still be an owe you one. There is a reason gifts are supposed to be reported though. No one should want their judges/justices bought and paid for. It is a bit naive to think the person giving said gifts isn't getting influence.

So FBI agents contact Homan, and hand him a bag full of cash. At what point was quid pro quo discussed and who brought it up? This sounds like really sloppy law enforcement. You gotta first set up the target. Make the target initiate the contact. Make the target ask for money. Make the target offer quid pro quo.
