No way to tell from that video. It doesn't matter who threw the first punch. It really matters more who was the attacker, which appears to be the pastor. The person who has no prospect of safe retreat is the one who basically gets a free pass. So once the good pastor crossed the street and started going at the guy, the first punch is (mostly) irrelevant.
You'd really need audio to judge it fairly. If the pastor is correct about what was said to him, he might have a case. He might still be the technical aggressor, but maybe he'd have a self-defense or temporary insanity affirmative defense.
For the record, if the pastor is telling the truth, I'm rooting for him, for sure. I'm just saying, it's not like he's clear of trouble just because the guy was an asshole. He seemingly was the attacking party. That doesn't sit well for him.

unless they can move the trial to NY or LA
Also, there's that. Even if the pastor was legally in the wrong, if his story can be defended in court, the best thing he can do is make sure he gets a jury trial, because that combined with his effeminate persuasion skills should win the day.

@oneeyedundertaker wants to hang jaywalkers, but I honestly think we could solve a lot of social problems just by legalizing beating the fuck out of assholes.
