It's a political mistake to be going after Senator and (CAPT, USN (retired)) Mark Kelly. There is no way this would ever even be a thing if the President didn't lose his mind over it and also the fact that there was no crime committed. I don't think he and the others should have done the video, but it's political, not criminal. No one gets recalled to active duty for crimes (even imaginary ones) committed as a civilian after retiring. Retirees have been recalled to active duty for prosecution of crimes committed on active duty prior to retirement. Most recent one I recall is a Lieutenant General recalled to active duty for prosecution for sexual assault committed prior to retirement. If that crime was committed after retirement he would have been tried in civilian court.
The big reason it's a political mistake is it pretty much guarantees Kelly's reelection and elevates him to the national stage. There's no chance he'll be convicted and if he's brought to active duty and prosecuted, he'll win and further increase his political stature. Just compare CAPT Kelly's career as a combat pilot with actual combat experience and as an astronaut who went into space multiple times, with the career of MAJ Hegseth. It makes MAJ Hegseth look inconsequential. It's like comparing a Great Dane to a yapping Toy Poodle. For most Americans Kelly's career will be considered heroic and Hegseth's just isn't. The Pentagon would never even conduct an investigation if the President didn't order it through the so-called Secretary of War. His JAG Officers are almost certain to report that there is no precedent for recalling a Senator to active duty and no case to be made if they did. Hegseth will probably pitch a fit like a toddler, and might fire somebody, but in the end, there will be no conviction. It's just not going to happen.
It's also a political mistake for the President. He's making it very hard to believe he's a "stable genius" and not conducting lawfare against political enemies (and he does call them enemies). Along his extremely poor polling numbers on the economy, his coattails for the mid-terms are likely to be short to nonexistent.
