Did Gov. Cox screw up?

Overall, I think Spencer Cox has done a fine job responding to the Kirk shooting, but a question for the legal-minded folks: did he screw up by repeatedly implying or even explicitly stating that Utah would pursue the death penalty? Does that automatically open up avenues of appeal for the defendant?

OT from your post, but watching all this coverage tracking the accused killer, it seems they’re making the next killer smarter on hiding him or herself?

I'm not even sure where Utah law ends and federal law begins on this kind of thing.

Again, politically, he did a helluva job. But now dude is in custody, we have to look forward to the prosecution, and I'm wondering if he threw some wrenches.

And if you’re worried the next criminal won’t be deterred enough just take a look at how Brian Kohlberger’s life has gone since being sentenced. Guy would probably pray for death.

  • Solitary confinement: Kohberger is in long-term restrictive housing in J Block, a unit for high-risk prisoners.
  • Daily routine: He spends 23 hours a day in his single-person cell and is only let out for one hour of outdoor recreation. He is moved in restraints during that time.
  • Harassment by other inmates: According to reports, other inmates were anticipating Kohberger's arrival and have organized a "campaign of harassment" against him.
    • They taunt him by shouting through the ventilation system and kicking his cell door.
    • Kohberger has also reported specific, explicit sexual assault threats from other named inmates.
    • Sources say the inmates know they are getting to him, especially since he has complained to guards.
  • Complaints to guards: Kohberger has lodged multiple complaints with prison staff, documenting the taunts and threats.
    • The Idaho Department of Corrections has acknowledged his complaints but notes that physical contact with other inmates is not possible in his isolated cell.
  • Other complaints: Kohberger has reportedly filed a complaint about the quality and portion sizes of his food.

Pure speculation, but I am guessing he will plead guilty with the DP off the table.

Im glad he’s off the street and can’t harm anymore. Maybe I’m not retributive enough but I doubt it.

 I would like a federal law that anyone who commits a a crime using a firearm is subject to twenty years of prison without the possibility of parole. 

I think that would be a massive deterrent and make the country a lot better.

@carramrod I’m obsessed with this case and if anyone deserves the death penalty it’s him. But you’re right. Prison is going to be hell on earth for him. He’s a vegetarian and he says he’s not getting the right kind of food. I’m sure they’ll get right on that.

Yeah, this turd is 22 years old. I’d rather he spent the next 60 years rotting in prison than be put to death.
