Typical Duty to Mitigate provisions require a good faith effort to find another job, but “good faith” is very much in the eye of the beholder. Even then, LSU will owe him the different between what he earns elsewhere and what they owe him, since he was fired without cause (as defined in his agreement).

He’s going to find tough sledding in the upper half of the P4 given his reputation as both unlikeable as disdainful of recruiting. You’re right, he needs to enjoy his very well funded retirement.

 

BK is 64 years old - retirement age. I wonder how that factors in to how hard he has to pursue a job?  
I’d retire to Florida and spend the rest of my life with the grandkids and on the golf course. 

 

I doubt it’s part of his contract, and I doubt that a judge would accept that as a compelling factor in not honoring the provisions of the agreement.

Fortunately, IU locked up Haines yesterday with a new 3 year extension that would put him at $3 million a year.

No way.

They - nearly - all require a good faith effort. Of course there is leeway, you still decide what job - so maybe they have arbitration. Maybe since i would be tough to prove it never is pursued.

But it has come up. Remember Belechick hiring Bielema for like $150k? Arkansas sued , because were paying like a million a year for another 6 years and they felt the low salary job was on purpose at them. Against contract language about good faith efforts to seek comparable employment.
