The Johnson Amendment

The Johnson Amendment is the IRS regulation prohibiting charitable organizations, covered by IRS exemption law, from engaging in politics.  This has been law since the 1950’s. 

Churches, particularly of the conservative variety, have challenged the Johnson Amendment on free speech grounds.  The Trump IRS acquiesced and entered a consent decree allowing churches, but not other organizations, to do politics and keep their tax exempt status.  

Naturally, the left leaning organizations are furious.  They are posturing the issue for a Supreme Court review.

Im about as ambivalent as one can be about this.  I don’t want to hear politics from the pulpit, but I sympathize with the free speech problem.  Maybe this will force an examination of the whole tax exemption issue.

I think the answer is to either not limit non-profits at all or to do away with the exemption entirely.
