@unclemark Let the state open an investigation and sue. What’s the issue? If the agent was in the wrong indict him. We should want accountability. I have no problem with that at all. Let the family sue him and the state indict him if it’s warranted.
I believe they plan on doing just that. But will the feds cooperate or impede? Will they even identify those involved? Will they preserve evidence? Will they honor discovery?
Answers to your questions:

2) They won't identify the 5 or 6 who beat the crap out of Pretti and then shot him repeatedly
3) They'll destroy evidence
4) They'd make a mockery of discovery if anything even gets that far

Scope is the threshold issue.
Here is how I explained it to a certificate class I taught to cops.
if a cop is in uniform, in a patrol car, and on duty, and he sees the high school kid who knocked up the cop’s daughter, and the cop stops,the kid and roughs him up on a made up charge, he is outside the scope even while in uniform and on duty.
Scope is the threshold question. Exceptions apply only when a cop acts outside the scope even if on duty.

That’s funny because I think Noem’s language in the aftermath of Goode’s shooting and this most recent one has been irresponsible at best and, more likely, purposely inflammatory. Completely unbecoming of the office she holds.

A competent administration would relieve Noem and the Border Patrol guy from their duties this week. In politics you can get away with a lot of hair splitting, but you can't go full Baghdad Bob and tell people that their own eyes are lying to them.
